WATERFOWL FEEDING ORDINANCE

Bedford County, Franklin County and Pittsylvania County

a.  That upon notice to the Virginia Department of Game and Inland Fisheries, the feeding of migratory and nonmigratory waterfowl is hereby prohibited in  [Bedford, Franklin, Pittsylvania Counties] in accordance with subsection c).

b.   For the purpose of this section, migratory and nonmigratory waterfowl shall be those species defined by the Virginia Department of Game and Inland Fisheries as any and all waterfowl in the Family Anatidae ducks, geese, and swans) including native, nonnative, and domestic ducks and geese, and any crossbreeds or hybrids of these birds and includes those species listed in the attachment to this ordinance.

c.   This prohibition is applicable to those areas of [Bedford , Franklin , Pittsylvania Counties] that are so heavily populated as to make the feeding of such waterfowl a threat to the public health or environment. Specific areas include all areas within the waters of Smith Mountain Lake, or within 500 feet of the Smith Mountain project shorelines.

d.   Specific areas cited within subsection c) shall be posted with the appropriate signage to designate the area where this section is applicable.

e.   Enforcement of this section shall be the sole responsibility of  [Bedford , Franklin , Pittsylvania Counties] .

f.   Any person violating the provisions of this section shall be subject to a civil fine not to exceed $50.00.

g.   No provision of this section shall be applicable on lands within a national or state park or forest, or wildlife management area.
